Service terms
These are draft commercial terms for evaluation. An executed pilot agreement with verified legal entity and contact information must replace this draft before a live customer launch.
Service boundary
BayBack provides missed-call event capture, one shop-approved acknowledgment, a human callback queue, suppression handling, and outcome reporting. It is not emergency service, a diagnostic tool, a CRM, a scheduler, a payment processor, legal advice, or a guarantee that a caller will become a customer.
Customer responsibilities
The shop must control or be authorized to route the applicable phone number, provide accurate business details, approve message content, train users, honor caller choices, maintain lawful notices and consent where required, and avoid entering sensitive payment, health, government-ID, or unnecessary personal data in notes.
Messaging activation
Live SMS stays disabled until the operator verifies Twilio registration, number ownership, opt-out behavior, exact message templates, webhook URLs, business-hours routing, and applicable TCPA, FCC, state, carrier, and platform requirements. Preview mode is for evaluation only.
Fees and pilot
Displayed prices are hypotheses, not a binding offer. Setup fees, telecom usage, service period, cancellation, refunds, data return, support, and success criteria belong in the executed order form. There is no unconditional recovered-jobs guarantee.
Availability and outcomes
The service is provided under the availability and support terms in the order form. Telecom carriers and customer phone systems may fail outside BayBack’s control. Recovery and revenue figures are staff-entered operational records and are not warranties of financial performance.
Suspension and termination
The operator may suspend live messaging for abuse, unsafe configuration, invalid registration, security risk, nonpayment, or legal/platform requirements. On termination, data is exported or deleted according to the order form and retention schedule, subject to suppression and legal obligations.
